- The use of the App and all data contained therein
- Data processing, storage, and transmission
- Security incidents, breaches, or unauthorized access
- Third-party service providers and their actions or omissions
- Client-provided data and its accuracy or reliability
- Any decisions or actions taken based on data from the App

YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY WAIVE, RELEASE, AND FOREVER DISCHARGE SKYDYNAMICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, AND EXPENSES OF ANY KIND, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, ARISING FROM OR RELATING TO THE APP OR THIS PRIVACY POLICY.
ESSENTIAL ELEMENT
THIS ZERO-LIABILITY PROVISION AND WAIVER IS A FUNDAMENTAL AND ESSENTIAL ELEMENT OF THE AGREEMENT BETWEEN YOU AND SKYDYNAMICS. SKYDYNAMICS WOULD NOT PROVIDE THE APP WITHOUT THIS PROVISION.

1. Data Controller and Data Processor Information
1.1 SkyDynamics as Data Processor
For Client Data and organizational user data, SkyDynamics operates as a DATA PROCESSOR, not a data controller. The client organization (airline, flight training organization, or other entity that has deployed the App) is the DATA CONTROLLER responsible for:
- Determining the purposes and means of processing personal data
- Obtaining all necessary consents from data subjects (their employees, trainees, instructors)
- Providing privacy notices to their end users
- Responding to data subject requests (access, deletion, portability)
- Ensuring compliance with GDPR, CCPA, and other applicable data protection laws
- All regulatory compliance and any associated fines or penalties
SkyDynamics, as a data processor, merely processes data on behalf of and under the instructions of the client organization. SkyDynamics assumes zero (€0) liability for client organizations' data protection compliance.
1.2 SkyDynamics as Data Controller
For limited administrative purposes (such as account management for direct SkyDynamics customers not affiliated with a client organization), SkyDynamics may act as a data controller. In such cases:

1.3 Client Organization Responsibility
If you are using the App through your employer or organization, your organization is the data controller for your personal data. You should direct all privacy inquiries and data subject requests to your organization, not to SkyDynamics. SkyDynamics assumes zero (€0) liability for your organization's data protection practices.

2. Important Notices and Disclaimers
2.1 Training Use Only - Critical Safety Notice
THE EBT INSTRUCTOR APP IS A SOFTWARE APPLICATION INTENDED EXCLUSIVELY FOR GROUND-BASED FLIGHT TRAINING AND EDUCATIONAL PURPOSES.
CRITICAL ACKNOWLEDGMENTS:
By using the App, you expressly acknowledge and agree that:
- The App is ONLY used on the ground - never during actual flight operations
- The App is ONLY used for training - never as an operational reference
- The App has NO safety-critical function - it cannot affect aircraft operation
- The App is SOFTWARE ONLY - it has no physical components capable of causing injury
- The App CANNOT cause death or personal injury when used as intended
- Any use during actual flight operations is STRICTLY PROHIBITED and constitutes a material breach of these terms
- Any misuse of the App is solely the user's responsibility - SkyDynamics has zero liability
- Users and organizations indemnify SkyDynamics for any claims arising from misuse
SKYDYNAMICS ASSUMES ZERO (€0) LIABILITY FOR ANY DEATH, PERSONAL INJURY, PROPERTY DAMAGE, OR AVIATION INCIDENT, AS SUCH OUTCOMES CANNOT RESULT FROM THE PROPER USE OF THIS GROUND-BASED TRAINING SOFTWARE APPLICATION. ANY SUCH CLAIMS NECESSARILY ARISE FROM USER MISUSE, FOR WHICH THE USER AND THEIR ORGANIZATION BEAR SOLE LIABILITY.
2.2 Client-Provided Data
All navigation data, airport information, aeronautical charts, training scenarios, competency frameworks, and related aviation content displayed within the App ("Client Data") is provided, managed, and maintained by the client organization and/or third-party data providers. SkyDynamics functions solely as a presentation layer and data display platform. SkyDynamics does not create, verify, validate, or authenticate any Client Data and assumes absolutely no responsibility or liability whatsoever (zero €0) for its accuracy, completeness, reliability, or any consequences arising from its use.
2.3 Organizational Context
The EBT Instructor App is typically deployed within organizational contexts (such as airlines, flight training organizations, or aviation academies). If you are using this App through your employer or organization, your organization may have its own privacy policies and practices that apply to your use of the App in addition to this Privacy Policy. Please consult your organization's privacy policies for additional information.
3. Categories of Personal Data We Collect

- Contact Lists: We do not access or collect your device's contact list
- Browsing History: We do not track your browsing activity outside the App
- Cross-App Tracking: We do not track your activity across other companies' apps or websites
4. Legal Bases for Processing (GDPR)
For users in the European Economic Area (EEA), United Kingdom, and Switzerland, we process your personal data on the following legal bases as provided under Article 6 of the GDPR:

Processing is necessary for the performance of our contract with you to provide the EBT Instructor App services. This includes:
- Creating and maintaining your user account

6.3 Legal and Regulatory Disclosures

Your personal data may be transferred to, and processed in, countries other than the country in which you reside. Specifically, our servers and those of our service providers are located in the United States and other countries.
7.1 Transfers from the EEA, UK, and Switzerland
When we transfer personal data from the European Economic Area (EEA), United Kingdom, or Switzerland to countries that have not been deemed to provide an adequate level of data protection, we implement appropriate safeguards to ensure your personal data remains protected. These safeguards include:
- Standard Contractual Clauses (SCCs): We use the European Commission's Standard Contractual Clauses for transfers to third countries
- Supplementary Measures: Where necessary, we implement additional technical and organizational measures to ensure the effectiveness of the transfer mechanism

By using the App and providing your personal data, you acknowledge that your data may be transferred internationally. If you do not wish for your data to be transferred internationally, you should not use the App.

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements.

- Encryption in Transit: All data transmitted between the App and our servers is encrypted using TLS 1.2 or higher
- Encryption at Rest: Sensitive data stored on our servers is encrypted using AES-256 encryption
- Secure Local Storage: Sensitive data stored locally on your device (such as authentication tokens) is stored in the iOS Keychain, which provides hardware-level encryption
- Password Security: Passwords are hashed using SHA-256 cryptographic hashing before transmission and storage; we never store plaintext passwords
- Token-Based Authentication: We use secure, time-limited authentication tokens rather than persistent credentials

No method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security. SkyDynamics assumes absolutely no liability whatsoever (zero €0) for any security breaches, unauthorized access, data loss, or any other security incidents, regardless of cause. In the event of a data breach that affects your personal data, we will notify you in accordance with applicable law. By using the App, you expressly acknowledge and accept all security risks and waive any claims against SkyDynamics arising from security incidents.
10. Your Privacy Rights
Depending on your location and applicable law, you may have certain rights regarding your personal data. We are committed to respecting and facilitating the exercise of these rights.
10.1 Universal Rights
Regardless of your location, you have the right to:

If you believe that we have violated your rights under the GDPR, you have the right to lodge a complaint with a supervisory authority. For users in Greece, this is the Hellenic Data Protection Authority (see Section 19).
12. Rights for California Residents (CCPA/CPRA)
If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

We will respond to your request within 45 days. If we need more time, we will notify you and may take up to an additional 45 days.
12.6 Financial Incentives
We do not offer financial incentives for the collection, sale, or deletion of your personal information.
13. Rights for Residents of Other U.S. States
13.1 Virginia (VCDPA)

13.3 Connecticut (CTDPA)
If you are a Connecticut resident, you have rights to access, correct, delete, obtain a copy of your data, and opt out of targeted advertising, sale of data, and profiling. To exercise these rights, contact us at ebt@skydynamics.aero.

If you are a Utah resident, you have rights to access, delete, and obtain a copy of your data, and opt out of targeted advertising and sale of data. To exercise these rights, contact us at ebt@skydynamics.aero.
13.5 Appeals Process
If we decline to take action on your request, you have the right to appeal our decision. To appeal, please email us at ebt@skydynamics.aero with the subject line "Privacy Rights Appeal." We will respond to your appeal within 60 days (or the timeframe required by your state's law).
14. Children's Privacy
The EBT Instructor App is a professional aviation training application and is not intended for use by children. We do not knowingly collect personal information from children under the age of 16 (or under the age of 13 in the United States).
14.1 Age Restrictions

We do not engage in cross-app tracking. We do not use the IDFA (Identifier for Advertisers) or any other tracking identifiers to track your activity across other companies' apps or websites.

We do not use third-party analytics services that track individual user behavior. Any usage data we collect is used solely for service improvement and troubleshooting purposes.
16. Client-Provided Data and Third-Party Content
16.1 Client Data
The EBT Instructor App displays navigation data, airport information, training scenarios, competency frameworks, and other aviation-related content that is provided by client organizations ("Client Data"). SkyDynamics:
- Does not create, verify, validate, or authenticate Client Data
- Does not have control over the accuracy, completeness, or reliability of Client Data
- Is not responsible for any errors, omissions, or inaccuracies in Client Data
- Functions solely as a platform to display data provided by clients
- Assumes absolutely no liability whatsoever (zero €0) for Client Data or any consequences arising from its use
The client organization bears sole and exclusive responsibility for all Client Data. SkyDynamics has zero (€0) liability for Client Data.
16.2 Third-Party Services
The App may integrate with third-party services and content providers. When you interact with these services, their privacy policies apply. We encourage you to review the privacy policies of any third-party services you use.
16.3 Links to Third-Party Websites
The App may contain links to third-party websites or services. SkyDynamics assumes absolutely no responsibility or liability whatsoever (zero €0) for the privacy practices, content, security, or any other aspect of these external sites. Please review the privacy policies of any third-party sites you visit. You expressly waive any claims against SkyDynamics arising from third-party websites or services.

SkyDynamics expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the App or data processing will be uninterrupted, timely, secure, or error-free
- Warranties that any data stored, processed, or transmitted will be accurate, complete, or reliable
- Warranties that any security measures will prevent all unauthorized access or data breaches
- Warranties regarding the availability or uptime of any services

SKYDYNAMICS ASSUMES ZERO (0) LIABILITY. THIS COMPLETE EXCLUSION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, BREACH OF WARRANTY, BREACH OF STATUTORY DUTY, OR OTHERWISE) AND EVEN IF SKYDYNAMICS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.
21.3 Maximum Liability Cap
IN NO EVENT SHALL SKYDYNAMICS' TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THIS PRIVACY POLICY, DATA PROCESSING, OR THE APP EXCEED ZERO EUROS (€0). SKYDYNAMICS ASSUMES NO FINANCIAL LIABILITY WHATSOEVER FOR ANY CLAIMS, DAMAGES, LOSSES, OR EXPENSES ARISING FROM OR RELATING TO THE APP, DATA PROCESSING, OR THIS PRIVACY POLICY.
You expressly acknowledge and agree that SkyDynamics provides the App and data processing services without assuming any financial liability, and that this zero-liability provision is a fundamental element of the basis of the bargain between SkyDynamics and users. This limitation shall apply even if any remedy fails of its essential purpose.
21.4 Jurisdictional Limitations
Some jurisdictions do not allow the complete exclusion of liability. In such jurisdictions, SkyDynamics' liability shall be excluded and limited to the absolute minimum extent permitted by applicable law, which in all cases shall be zero (€0) or the lowest amount legally permissible. You expressly waive any and all claims against SkyDynamics to the maximum extent permitted by law. Any liability that cannot be legally excluded shall be limited to the re-performance of services, at SkyDynamics' sole discretion, and under no circumstances shall include monetary compensation.
21.5 Specific Liability Exclusions and Limitations
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) FRAUD AND INTENTIONAL MISCONDUCT: You acknowledge that SkyDynamics operates in good faith and that any claims of fraud or intentional misconduct must be proven by clear and convincing evidence. Any such claims shall be subject to the exclusive jurisdiction of the courts of Athens, Greece, and you waive any right to bring such claims in any other jurisdiction. You agree that any damages for fraud or intentional misconduct, if proven, shall be limited to direct damages actually suffered and documented, excluding all consequential, incidental, indirect, special, or punitive damages. You further agree to indemnify SkyDynamics for all costs and legal fees if any claim of fraud or intentional misconduct is not proven.
(b) GROSS NEGLIGENCE: You acknowledge that SkyDynamics exercises reasonable care in providing its services. Any claim of gross negligence must demonstrate a conscious and voluntary disregard of the need for care, which in light of the facts, creates a substantial risk of serious harm. You agree that any liability for gross negligence, to the extent it cannot be excluded, shall be limited to direct damages actually suffered and shall exclude all consequential, incidental, indirect, special, or punitive damages. You further agree to indemnify SkyDynamics for all costs if any claim of gross negligence is not proven.
(c) DEATH OR PERSONAL INJURY: The EBT Instructor App is a SOFTWARE APPLICATION for GROUND-BASED TRAINING ONLY. It is NOT used in flight operations, NOT used in any safety-critical environment, and NOT capable of causing death or personal injury. You expressly acknowledge that:
- The App is used exclusively on the ground for training purposes
- The App has no physical components that could cause injury
- Any use of the App during actual flight operations is STRICTLY PROHIBITED and constitutes a breach of these terms
- Any death or personal injury arising from misuse of the App (including use during flight operations) is the sole responsibility of the user and/or their organization
- SkyDynamics assumes zero (€0) liability for any death or personal injury, as such outcomes cannot result from proper use of a ground-based training software application
- Any claim of death or personal injury would necessarily arise from user misuse, for which the user and their organization bear sole liability and agree to indemnify SkyDynamics
(d) REGULATORY FINES AND GDPR: You acknowledge and agree that:
- SkyDynamics operates as a DATA PROCESSOR, not a data controller, for Client Data - the client organization is the data controller responsible for GDPR compliance for their end users
- Client organizations bear sole responsibility for their own GDPR compliance, including obtaining consents, providing privacy notices, and responding to data subject requests
- Any GDPR fines or regulatory penalties arising from Client Data or client organization practices are the sole responsibility of the client organization
- Client organizations agree to indemnify SkyDynamics for 100% of any regulatory fines, penalties, or enforcement costs arising from the client's data or practices
- To the extent SkyDynamics is considered a data controller for its own operations, SkyDynamics' liability for any GDPR fines shall be limited to the minimum extent permitted by law, and users/clients agree to indemnify SkyDynamics for any fines arising from user-provided data or user/client actions
22. Indemnification
22.1 Your Indemnification Obligations
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS SKYDYNAMICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, SUPPLIERS, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES AND COURT COSTS) ARISING OUT OF OR RELATING TO:
- Your violation of this Privacy Policy or applicable data protection laws
- Your provision of inaccurate, incomplete, or false personal data
- Your failure to maintain the security of your account credentials
- Any personal data you provide about third parties without their consent
- Any Client Data provided by you or your organization
- Your organization's failure to comply with data protection obligations
- Any claims by third parties arising from your use of the App or data processing services
- Your violation of any third-party rights, including intellectual property rights
- Any regulatory investigations, fines, or penalties resulting from your actions or omissions
22.2 Organizational Indemnification
If you are using the App on behalf of an organization, that organization agrees to indemnify, defend, and hold harmless SkyDynamics from any claims arising from:
- The organization's data protection practices and policies
- The organization's collection, use, or disclosure of personal data
- Any Client Data provided by the organization or its authorized users
- The organization's failure to obtain necessary consents from data subjects
- Any regulatory enforcement actions against the organization relating to data processed through the App
- Any GDPR, CCPA, or other data protection fines or penalties of any kind
- Any regulatory investigations, audits, or enforcement actions
- Any claims of death, personal injury, or property damage arising from misuse of the App
- Any aviation incidents, accidents, or regulatory violations
- Any claims by the organization's employees, trainees, contractors, or third parties
THE ORGANIZATION'S INDEMNIFICATION OBLIGATION INCLUDES 100% OF ALL:
- Regulatory fines and penalties (including GDPR fines up to €20 million or 4% of global turnover)
- Legal fees, costs, and expenses
- Settlement amounts and judgments
- Investigation and remediation costs
- Reputational damages
22.3 Indemnification Procedures
SkyDynamics will promptly notify you of any claim subject to indemnification and will provide reasonable cooperation in the defense of such claim. SkyDynamics reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with SkyDynamics in asserting any available defenses.
22.4 Scope of Indemnification
YOUR INDEMNIFICATION OBLIGATIONS ARE ABSOLUTE, UNCONDITIONAL, AND WITHOUT LIMITATION. You agree to indemnify SkyDynamics for:
- 100% of all legal fees, costs, and expenses incurred in defending any claim
- 100% of all damages, judgments, settlements, fines, and penalties arising from any claim
- 100% of all regulatory fines, penalties, and enforcement costs of any kind
- All consequential, incidental, and indirect damages suffered by SkyDynamics
- All costs of investigation, remediation, and notification related to any incident
SkyDynamics shall have zero (€0) liability, and you shall bear 100% of all costs and damages arising from any claims, regardless of cause or fault.
23. Client-Provided Data: Comprehensive Disclaimer
23.1 SkyDynamics' Role as Presentation Layer
SKYDYNAMICS FUNCTIONS EXCLUSIVELY AS A PRESENTATION LAYER AND DATA DISPLAY PLATFORM. All navigation data, airport information, aeronautical charts, runway data, airspace information, flight procedures, organizational data, training scenarios, competency frameworks, and any other aviation-related or training-related content displayed within the App ("Client Data") is fully provided, uploaded, managed, and maintained by the client organization, their designated administrators, and/or third-party data providers.
23.2 Complete Disclaimer of Responsibility
SKYDYNAMICS EXPRESSLY AND UNEQUIVOCALLY DISCLAIMS:
- ANY AND ALL RESPONSIBILITY for the creation, verification, validation, authentication, accuracy, completeness, currency, or reliability of any Client Data or personal data provided by clients
- ANY AND ALL LIABILITY for errors, omissions, inaccuracies, outdated information, or any defects in Client Data or personal data
- ANY AND ALL WARRANTY regarding the correctness, completeness, fitness for purpose, or reliability of Client Data or personal data
- ANY AND ALL RESPONSIBILITY for decisions, actions, or outcomes based on Client Data or personal data
- ANY AND ALL LIABILITY for damages, injuries, incidents, or losses arising from the use of or reliance on Client Data or personal data
- ANY AND ALL RESPONSIBILITY for the lawfulness of data collection by client organizations
- ANY AND ALL LIABILITY for clients' compliance with data protection laws in their respective jurisdictions
23.3 Client Organization Responsibilities
THE CLIENT ORGANIZATION BEARS SOLE, COMPLETE, AND EXCLUSIVE RESPONSIBILITY FOR:
- The accuracy, validity, legality, and correctness of all personal data and Client Data provided to SkyDynamics
- Obtaining all necessary consents from data subjects for the collection and processing of their personal data
- Ensuring compliance with all applicable data protection laws in the client's jurisdiction
- Providing accurate privacy notices to their end users
- Responding to data subject requests from their employees and trainees
- Maintaining appropriate data protection agreements with SkyDynamics
- Any regulatory fines, penalties, or enforcement actions arising from the client's data protection practices
23.4 Third-Party Data Providers
SkyDynamics has absolutely no responsibility or liability for personal data or content provided by third-party data providers, including but not limited to:
- Navigation database providers
- Airport and aeronautical data providers
- Mapping and geospatial data providers
- Any other external data sources
The client organization and/or the original data provider bears full responsibility for the lawfulness and accuracy of such data.
24. Third-Party Service Providers: Disclaimer
24.1 No Control Over Third Parties
While SkyDynamics carefully selects its third-party service providers, SkyDynamics does not control and is not responsible for the privacy practices, data processing activities, security measures, or compliance of any third-party service provider, including but not limited to Supabase, Couchbase, Apple, and any other vendors.
24.2 Zero Liability for Third Parties
SKYDYNAMICS ASSUMES ABSOLUTELY NO LIABILITY WHATSOEVER (ZERO €0) FOR:
- Any data breaches, security incidents, or unauthorized access occurring at third-party service providers
- Any data loss, corruption, or destruction caused by third-party service providers
- Any downtime, service interruptions, or unavailability of third-party services
- Any changes to third-party privacy policies or data processing practices
- Any actions or omissions of third-party service providers
- Any regulatory fines or penalties imposed on third-party service providers
- Any failure of third-party service providers to comply with data protection laws
- Any damages, losses, costs, or expenses of any kind arising from third-party services
- Any claims by you or any third party relating to third-party service providers
YOU EXPRESSLY RELEASE AND WAIVE ANY AND ALL CLAIMS AGAINST SKYDYNAMICS ARISING FROM OR RELATING TO THIRD-PARTY SERVICE PROVIDERS.
24.3 Your Acknowledgment and Waiver
By using the App, you expressly acknowledge, agree, and confirm that:
- Your personal data will be processed by third-party service providers
- SkyDynamics cannot guarantee the security or privacy practices of third parties
- You have reviewed and accept the privacy policies of relevant third-party providers
- SkyDynamics has absolutely no liability (zero €0) for any acts, omissions, breaches, or failures of third parties
- You waive any and all claims against SkyDynamics arising from third-party services
- You assume all risks associated with third-party data processing
25. Security Incidents and Data Breaches
25.1 Notification Obligations
In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, SkyDynamics will:
- Notify the relevant supervisory authority within 72 hours of becoming aware of the breach (where required by law)
- Notify affected individuals without undue delay where the breach is likely to result in a high risk to their rights and freedoms
- Document the breach, its effects, and remedial actions taken
25.2 Zero Liability for Security Incidents
NOTWITHSTANDING ANY SECURITY MEASURES IMPLEMENTED BY SKYDYNAMICS, YOU EXPRESSLY ACKNOWLEDGE, AGREE, AND ACCEPT THAT:
- No security system is impenetrable, and SkyDynamics cannot guarantee that unauthorized access will never occur
- SkyDynamics assumes absolutely no liability whatsoever (zero €0) for any security incidents, data breaches, unauthorized access, or cyberattacks, regardless of cause, including but not limited to: sophisticated cyberattacks, zero-day vulnerabilities, acts of third parties, insider threats, or force majeure events
- SkyDynamics has zero (€0) liability for security incidents as set forth in Section 21 of this Privacy Policy
- You are solely responsible for maintaining the security of your own account credentials and devices
- You expressly waive any and all claims against SkyDynamics arising from or relating to security incidents
- You assume all risks associated with the transmission and storage of data
25.3 Your Obligations in Case of Security Incidents
You agree to:
- Immediately notify SkyDynamics if you become aware of any unauthorized access to your account or personal data
- Cooperate with SkyDynamics in investigating and mitigating any security incidents
- Take reasonable steps to protect your account, including changing passwords and enabling security features
26. Force Majeure
SkyDynamics assumes absolutely no liability whatsoever (zero €0) for any failure, delay, interruption, data loss, breach, or any other consequence arising from circumstances including but not limited to:
- Acts of God, natural disasters, earthquakes, floods, fires, or severe weather
- War, terrorism, civil unrest, or armed conflict
- Epidemics, pandemics, or public health emergencies
- Government actions, laws, regulations, or embargoes
- Failure of telecommunications, internet infrastructure, or power supply
- Cyberattacks, hacking, or malicious software attacks
- Actions or omissions of third-party service providers
- Labor disputes, strikes, or work stoppages
- Any other circumstances beyond SkyDynamics' direct control
- Any circumstances within SkyDynamics' control that SkyDynamics deems to constitute force majeure
During any force majeure event, SkyDynamics' obligations shall be immediately suspended without liability, and SkyDynamics shall have zero (€0) liability for any resulting data loss, breach, processing delays, or any other damages or consequences whatsoever. You expressly waive any claims arising from force majeure events.
27. Severability and Survival
27.1 Severability
If any provision of this Privacy Policy is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

28.4 EEA Residents
For users in the European Economic Area, nothing in this section shall deprive you of the protection afforded by mandatory provisions of the law of your country of residence, nor shall it prevent you from bringing claims before the courts of your country of residence or lodging complaints with your local supervisory authority.
29. Entire Agreement
This Privacy Policy, together with our Terms of Service, constitutes the entire agreement between you and SkyDynamics regarding the collection, use, disclosure, and processing of your personal data in connection with the EBT Instructor App, and supersedes all prior agreements, representations, and understandings, whether written or oral.
30. No Waiver
The failure of SkyDynamics to exercise or enforce any right or provision of this Privacy Policy shall not constitute a waiver of such right or provision. Any waiver of any provision of this Privacy Policy will be effective only if in writing and signed by an authorized representative of SkyDynamics.
